The Government’s VAT raid on private schools is discriminatory against certain pupils, the Independent Schools Council (ISC) has claimed in a legal challenge.
The lobby group, which represents more than 1,400 private schools, filed a judicial review claim against Sir Keir Starmer’s flagship education policy on Friday.
In a High Court legal challenge, the ISC alleged the Government’s plans to hit private schools with VAT from Jan 1 undermined the human rights of some children.
Six families will take part as case studies. They include children with special educational needs or disabilities (Send), a vulnerable girl in a single-sex school, minority Jewish and Muslim families, and foreign nationals in bilingual schools.
Their identities are expected to remain anonymous. The Telegraph understands they will argue that the Government’s plans to add 20 per cent VAT to school fees could price them out of private education and into the state sector, where their needs cannot be met.
